CFTC crypto exchange registration: voluntary federal pathway advances as CLARITY Act stalls

The CFTC took the next step toward a voluntary federal registration pathway for crypto exchanges this week, and for once the regulatory calendar, not a spot price, is the story. Chairman Mike Selig reiterated the agency's position on Oct 26 as the parallel legislative route to clearer market rules, the CLARITY Act, remains stalled in the Senate. For an industry that has spent years asking where a US exchange is meant to fit, the advance notice of proposed rulemaking now on the table is the closest thing to an answer.
The mechanics matter because of what the agency is not doing. The ANPRM opened Oct 5 covers Regulation CTX and Regulation CAM, the CFTC's first rule package written specifically for crypto trading venues and intermediaries. Under the proposed structure, an exchange that opts into federal registration gets a single, national framework to operate under rather than a patchwork of state-level regimes, which is exactly the clarity institutional operators have said they need before committing capital at scale.

The voluntary design is the distinguishing feature. Rather than mandating that every venue register with the federal agency, the pathway leaves the choice with the exchange: sign up for federal oversight and comply with its reporting, capital and customer-protection standards, or continue under existing state frameworks. The comment window, which closes Dec 14, is where the market pushes back on the details, and industry and legal observers will be watching how the agency draws the line between the two lanes.
The legislative half of the picture is why the rulemaking matters more than usual. The CLARITY Act, which would codify crypto market structure in statute, has not moved in the Senate. That stall leaves the CFTC's ANPRM as the most concrete federal vehicles for defining how US crypto exchanges operate, and it raises the stakes for the Dec 14 comment deadline: participants who want a seat at the table in shaping the eventual rule have a fixed calendar on which to get there.

What to watch next is the comment period itself. How many submissions arrive, and from whom, will signal whether the voluntary framing is landing with the operators it is designed for, and whether the CLARITY Act's fate changes how much weight the final rule ends up carrying.
