The SEC moved last week to make it easier for investment advisers and regulated funds to hold crypto, a quiet regulatory positive in a week when institutional flows turned decisively negative. The commission proposed custody rules on Oct 1 (published in the Federal Register Oct 6) that would loosen how advisers and funds safekeep digital assets under federal securities law, advancing the institutional onboarding story through rulemaking even as the broader market-structure bill remains stalled in Congress (SEC press release; CNBC).

The timing matters because the rulemaking is moving while the asset tape is not. Spot bitcoin ETFs are net negative for a second straight week, sitting at roughly $151 million in outflows through Wednesday after a $681 million redemption in the week to Oct 9, with a $262 million outflow on Oct 15 reversing the prior day's $176 million inflow (SoSoValue via FXStreet). Ether funds have been the weak point, shedding about $190 million this week after losing $542 million the week before. Solana ETFs have now posted eight straight daily outflows. XRP stands alone as the only tracked category in positive weekly territory, thanks to a modest $740,000 inflow (FXStreet/SoSoValue, Oct 15).

The regulatory trajectory and the flow picture point in opposite directions. The SEC's framework is designed to remove a structural obstacle for large institutions: under current rules, advisers that custody crypto through an unqualified custodian have faced limits on how they treat those assets. The proposal offers a clearer path, and the commission is pursuing it through its own authority while Congress has not advanced broader market-structure legislation (SEC press release, Oct 2026; CNBC, Oct 2).

For now the near-term driver remains the macro tape. A hotter-than-forecast September CPI has CME FedWatch pricing roughly 54% odds of a Federal Reserve rate hike at the Oct 27-28 meeting, which keeps crypto trading like a liquidity asset tied to yields and the dollar. The custody proposal does not change that arithmetic, but it does signal that the regulatory path for larger institutional participation is gradually clearing even as this week's flows, concentrated in the largest-cap names, stay red.

Watch the Oct 27-28 FOMC as the decisive near-term catalyst. If sky-high hike odds unwind, two weeks of institutional outflows and oversold positioning could flip quickly. If not, the custody story remains a medium-term structural positive layered under a macro-driven correction.
